Each Canadian Individual – whether an indigenous aboriginal or not – appears to be entitled to Paid-For Competent Legal Counsel Of Their Choice.

International Law has been establishing a series of successful individual claims to courts and human rights commissions for the securing of legal expenses to be paid for where an individual can demonstrate that they do not possess adequate funds to pay for competent legal counsel on their particular issue.

In Ireland, a lady – who was in a divorce dispute – could not afford a lawyer to argue on her behalf. The European Court Of Human Rights agreed that she should be provided for with state-funded legal counsel. Ireland amended it’s legislation and laws to comply with the ECHR decision.

In the United States, a poor man charged with a criminal offence and could not afford a lawyer, was awarded similar state-funded adequate legal counsel.

These provisions have been reviewed by several legal scholars and institutions. And, there is a general agreement that this is an important social benefit.

In Canada, there is still apprehension by the federal and provincial governments to provide adequate and continuous funding for legal aid. Many people who apply for legal aid are denied; and, advised that legal aid is for very limited services – which the Legal Aid Societies advise, are under-funded.

THE FIRST STEP is for individuals to APPLY for LEGAL AID. If YOU are DENIED; then, there are application-of-law avenues to follow up with ASAP.

Several DENIALS have been accumulated now. And, therefore, there is an existing basis through which to launch Class Action Claim.

This process will likely help fund the DAY SCHOOL VICTIMS Class Action By Joan Jack. And, it will certainly help in recivering the legal fees paid to lawyers on the Indian Residential Schools Victims Claims – This issue is now ready to proceed to the three international human rights Commissions and Courts. Please, note that Elizabeth II – as Queen and ward hoder of all indigenous aboriginal Peoples – can be personally sued in court for damages in England and in Canada [as well as at the UN Security Council.]
