Finding The Critical Mass For Conviction On Issues Of Corporate Crime
Question : At what point of a dispute between Parties is it legitimate for Government to act; namely, to intervene with Investigations of Allegations ?
Clarification : In this regard, What Information File is required to justify a state agency / police force to innitiate an investigation under the Criminal Code. And, at what point do Complainant Parties have a justifiable good cause to proceed to civil court for remedies ?
Summary : The foregoing applies in this instance to the question of allegations of "corporate" offences. And, in Canada, there is the primary question to resolve regarding jurisdiction of law and conflict of laws; both through constitutional challenges and via the parameters of international law. These criteria apply in particular on the Issues of Indigenous Peoples complaints : I.E., What court of competent jurisdiction is to be accepted in the absence of a Treaty between Crown Elizabeth II Canada and the Complainant Parties. And, what factors must be accomplished for the Crown to puruse criminal charges ? [i.e., a conviction must be evident]; and, what are the turning points in a civil case where a judge / settlement officer will rule in favour of the Complainant(s) ?
Definitions :
(A) Corporation : Any entity - whether legal or illegal - that has an organized operation or plan in place to manage a particular issue. This may include private and public enterprises; such as government agencies, churches, international and / or regional business enterprises, political , social, sports, theatric, intellectual groups, banks, military; and, any other concerted or individual activity that incorparates a plan to achieve a specific purpose
(B) First Nations : The term "Indian" in Canada refers to Indigenous. Original Peoples, or, Aboriginal Peoples. First Nations is a designation created by Canada to define Peoples who are regulated through the Indian Act - where "Indian" is noted
(C) Complainant : An individual or group of people who are seeking some legal redress on an issue defined within some context of law
(D) Legal Duty To Investigate / Prosecute / Convict or Dismiss On Complaints : A Just Society will always find adequate financial and professional resources to receive and consider an apparent legitimate Complaint
